1. Scope

These Terms & Conditions apply to all purchases made through the Rising Yellow website.

The presentation of products on this website does not constitute a legally binding offer but an invitation to place an order.

By placing an order, you make a binding offer to purchase the selected product.

3. Prices & Payment

All prices are stated in euros (€) and include applicable VAT.

Shipping costs are displayed at checkout.

Payments are processed securely via Stripe and other available payment providers.

4. Order Process

After placing an order, you will receive an automatic order confirmation email. This email confirms receipt of your order but does not yet constitute acceptance of the contract.

The contract is concluded once the order is confirmed and shipped.

5. Delivery & Shipping

Orders are processed and shipped within the stated processing time.

Delivery times may vary depending on destination.

Shipping costs are displayed during checkout before purchase.

For deliveries outside the European Union, customs duties, taxes, or import fees may apply and are the responsibility of the recipient.

6. Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you receive the goods.

To exercise your right of withdrawal, you must inform us via email at:

by means of a clear statement of your decision to withdraw from the contract.

7. Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, excluding shipping costs where applicable.

Refunds will be issued within 14 days after we receive the returned goods.

Returned items must be unused and in their original condition.

You are responsible for return shipping costs unless the item arrived damaged or incorrect.

8. Damaged or Incorrect Items

If your order arrives damaged or incorrect, please contact us within 7 days of delivery.

We will arrange a replacement or refund.

9. Liability

We are liable without limitation for damages resulting from injury to life, body, or health and in cases of intent or gross negligence.

For slight negligence, we are only liable for breaches of essential contractual obligations.

10. Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the country in which the consumer resides remain unaffected.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
